Distance selling
Under the Distance Selling Regulations you have a right to cancel your order (prior to shipment, see cancellation terms below) for any item purchased on this website, for a full refund. This does not apply to Special order items or items made to your specification.

Specific delivery date orders
It may be possible to request delivery for a specific date. The Fitness Shop will endeavour to fulfil your request, however it cannot be guaranteed. The Fitness Shop will not entertain any claim whatsoever for compensation arising from late delivery due to a third party carrier. If we have the item in stock in our premises, we can offer an overnight service if the goods are ordered before 1pm the previous day. If a specific date has been given by yourself and no-one is there to sign for the consignment then you will be charged for any re-deliveries.

Order Cancellation/ Refused Deliveries
You may cancel your order for a full refund prior to your order being shipped. If you cancel your order after it has been shipped, you are responsible for any and all freight charges incurred by ourselves. Any unpaid freight charges will be deducted from your refund. If you refuse to accept delivery of your order for any other reason than the product being damaged in transit, you are liable for all outward and return freight charges incurred by you refusal. If it is found that any of the larger products upon delivery will not fit through any doors/stairwells and the product is subsequently returned/refused, you are responsible for all outward & return carriage costs. It is your responsibility to ensure the product will fit into its designated space and can be transported to its ground floor point of installation easily. If you need to confirm the boxed dimensions of a product please call The Fitness Shop prior to placing your order.

Restricted Access
Due to the size of some delivery vehicles, The Fitness Shop or any carriers delivering on behalf of us MUST be informed of ANY restrictions regarding access for the delivering vehicles. This includes but not limited to, steps (including those required to climb to gain access to the property entrance), steep driveways, narrow lanes, tight bends or any other restrictions that may make it difficult for the delivering vehicle to gain access to the point of delivery. The Fitness Shop will not accept any claims for compensation arising from non/failed/refused delivery of any item where the carriers or we were not made aware of any points regarding access restrictions. In the event that the item is refused/cancelled due to these restrictions, the customer is liable for all carriage charges incurred.

Delivery terms
Due to the excessive weight and physical size of some items and regarding Health & Safety regulations, upstairs deliveries are at the carriers discretion and are not guaranteed. This includes (but not limited to) steps that are immediately outside the premises, which are required to climb in order to gain access to the property.

Delivery (one man)
All orders are processed and shipped in the order that they are received. Normal delivery time is 5 to 10 working days. Please note that unless the carrier/supplier offers a delivery booking in service your order will arrive without prior notification. A card will be left if no-one is home & the goods returned to the carriers local depot to await your contact. The freight delivery service you receive may vary among carrier companies. Since most carriers deliver to the curb side immediately adjacent to their vehicle and regard inside delivery as an extra service cost, it may be necessary for you to assist or move merchandise into your home, this is especially relevant if you live in a block of flats as carriers will only deliver to the ground floor entrance to the block. If you have alternative delivery requirements, please contact The Fitness Shop.
Be sure to include one or two phone numbers, preferably a landline and a mobile, in case the carrier needs to notify you to arrange delivery. If, when the carrier arrives with your goods after pre-arrangement there is no-one present to receive them, they will be returned to the carrier’s depot, or to the supplier. In this case you will be liable for ALL charges for re-delivery. Please note, if the order is subsequently cancelled, you will be liable for all carriage charges. There may be an extra charge for a two man delivery if requested by the customer, please check when ordering.

Delivery (two man)
This service is only available on certain products (check at time of order). Although the carrier will place the product in the ground floor room of your choice, this is subject to good and safe access.
Please note that all of the above terms regarding access and upstairs deliveries still apply even though it is a two man delivery.
Please allow at least 10 working days for this service. These larger products have pre-arranged deliveries, which means the item will be booked in with you by the carrier or the supplier. If when the carrier arrives with your goods after pre-arrangement and there is no-one present to receive them, they will be returned to the carrier’s depot, or to the supplier. In this case you will be liable for ALL charges for re-delivery. Please note, if the order is subsequently cancelled, you will be liable for all carriage charges. There may be an extra charge for a two man delivery if requested by the customer please check when ordering.
All deliveries are made Monday - Friday between 8am & 6pm. Our carriers are unable to give specific times for delivery.
The Fitness Shop will not be held responsible for any delays/damages due to third party carriers, nor will we entertain any claims for compensation where the carrier fails to deliver at an agreed time. Any claims for damages to property caused by any third party carrier must be taken up with them directly.

Shortages or Damages
YOU MUST KEEP ALL PACKAGING. UNDER THE TERMS OF WARRANTY YOU WILL BE REQUIRED TO RE-PACK ANY FAULTY ITEMS IN THE ORIGINAL PACKAGING FOR RETURN TO The Fitness Shop. When the delivering carrier brings your order you MUST count the pieces you receive & look for any damage. It is noted on the carrier’s delivery note, the number of boxes you should receive. If the number of boxes you receive does not exactly match the number of pieces on the carrier’s delivery note, you MUST note the number of pieces you received on the delivery note by your signature. Damage to the equipment / packaging MUST be noted on the delivery note next to your signature. THE WORDS “UNEXAMINED” OR “UNCHECKED” WILL NOT BE ACCEPTED AS A CONDITIONAL SIGNATURE. You must cross out “delivered in good condition” from the carrier’s delivery note. It is VERY important to check your order. A signature is an acceptance that you have received the whole order in good condition. Any shortages or damages must be reported to The Fitness Shop within 48 hours of signing. Neither The Fitness Shop nor the carrier can be held responsible for shortages or damages if you do not note them on your delivery note. This does not affect your statutory rights in the event of the goods being faulty. All damage and shortage claims must be filed with the carrier; therefore The Fitness Shop are subject to the Carriers terms and conditions. Collections/Faulty Products
In the event of an item being received that either develops a fault (proof of purchase will be required) or is found to be faulty upon delivery, we will arrange to have this item either inspected on site by an engineer(as some faults can just be related to a loose connection, etc.) or collected free of charge. Items to be collected must be packed in the original packaging and be made available for collection by our carriers within 24hrs of you notifying us they are faulty. If when the carrier arrives to collect the goods, they are found not to be available/ready, a charge, which will be payable by you, will be made for the carrier to recollect. Once the items are received back at The Fitness Shop, we will inspect the product(s), and if necessary arrange to send out a replacement product. Please note that if the product is found on inspection NOT to be faulty on its return to us, we may send this item back to you, and all delivery charges will be payable by you. Please note that if proof of purchase cannot be shown, then we reserve the right to charge for any/all repairs. In the event of special order items that are received faulty, we will of course rectify this by either replacing the faulty part within the item, or if the entire product is faulty, a full replacement will be sent. Please note: You will be required to contact the manufacturer/supplier direct for any service issues or faults with your product as this gives the quickest response.

Exchanges or Returns
YOU MUST KEEP ALL PACKAGING. YOU WILL BE REQUIRED TO RE-PACK ANY ITEMS IN THE ORIGINAL PACKAGING FOR RETURN TO The Fitness Shop. WE CANNOT ACCEPT ANY ITEMS FOR RETURN THAT ARE NOT IN THEIR ORIGINAL PACKAGING UNLESS FAULTY. Our exchange and return policy is simple. If within your 10 day home approval you wish to return or exchange an item, Call 029 2062 6773 9am to 5.30pm Monday through to Friday, to authorise a return.
All returns and exchanges must be shipped back, freight prepaid by yourself, unused/unbuilt and must arrive “in like new condition in the original boxes”. You must contact The Fitness Shop within 10 Days from the day after you receive your shipment in order to receive returns authorisation. You will be charged for items received back that when inspected have been found to have been used or built. Special order items, i.e. some larger items despatched directly from the supplier (please check prior to ordering) or items made to your specifications are not returnable. In the event of special order items that are received faulty, we will rectify this by either replacing the faulty part within the item, or if the entire product is faulty, a full replacement will be sent. Refunds may be obtained on completed returns or for the difference in exchanges. Shipping and handling charges are the responsibility of the customer and are not refundable. Please note, goods purchased instore are exchanged at the managers discretion.

Installation
We are happy to quote for the installation of any product.

If you require installation on a product / products, the time between order & installation may be longer than for that of delivery only. We will always try to arrive on time, but will not be held responsible for late arrival due to unforeseen circumstances. Please ensure that the space for the product/s has been cleared & that access is unrestricted. We must be informed at the time of placing the order where the product/s are to be installed. All prices quoted are for ground floor installations in the main building of the property or a garage at side of the main part of the building. Installations above or below ground floor may be subject to a surcharge, especially if not mentioned at the time of order. You may be asked to assist the installer to get the product/s to their location, if no help is available then a 2 man installation may be required at extra cost. The Fitness Shop are within their rights to refuse any installation if the installer deems the installation location to be hazardous or the request unreasonable. If the product does not fit into the area where the installation is requested & a representative of The Fitness Shop did not measure the area, then The Fitness Shop cannot be held responsible, therefore the customer will incurr the cost of the visit. Agreed installation times must be adhered too. It is the customer’s responsibility to check that the installation has been carried out to their satisfaction. If the customer is not present when the installation is completed the installation will be deemed as completed to the customers satisfaction. Any subsequent visits that may be required will be chargeable at the same rate as the first visit.

General information
Generally all products are delivered flat packed and will require assembly by you. Installation is available for an extra charge. All delivery charges shown on our web site are for delivery to UK mainland only. We do not ship goods overseas or to any other parts of Europe. For further details please call on 029 2062 6773.
